Terms & Conditions These Terms and Conditions ("Terms") constitute a legally binding agreement between Arborista Limited, a company registered in the United Kingdom ("Arborista," "we," "us," or "our"), and the users (the “client”, "you" or "your") of Arborista's tree services. By accessing or using Arborista's services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please refrain from using our services.
1. Scope of Services Arborista Limited provides professional tree services, including but not limited to tree pruning, removal, stump grinding, tree health assessments, and consultancy services (collectively, the "Services"). All work shall be carried out in line with BS3998 (“Recommendations for Tree Work”) where appropriate unless instructed otherwise by the customer. We shall undertake the work in a competent manner in compliance with the specification and price detailed in the attached estimate.
2. Quotes and Pricing Arborista Limited shall furnish a comprehensive quotation for the services requested, the validity of which extends for a period of 14 (fourteen) days. The quoted prices are subject to modification in the event of alterations to the scope of work. Upon the acceptance of our quotation, whether conveyed verbally or in written form, a legally binding contract shall be established between Arborista Limited and the client. All prices specified exclude applicable taxes unless explicitly stated otherwise. The client undertakes to remit to Arborista Limited the agreed-upon sum for the services as specified in the provided quotation. Payment is expected upon the completion of the services, unless an alternative arrangement has been specified in writing. Delayed payments may incur interest charges, and Arborista Limited retains the right to recover any costs associated with the retrieval of outstanding payments. Should modifications to the requested work arise due to changes in job requirements before arriving onsite, alterations in site or ground conditions since the initial visit, additional works requested or required during on-site operations, or actions initiated by local residents, council, police, or any external party, the estimate shall be duly revised. Such revisions may be communicated electronically in advance or conveyed through a handwritten note on the day of the work.
3. Booking and Scheduling Arborista Limited will work with the Client to schedule the Services at a mutually agreed-upon date and time. The Client understands that scheduling may be subject to change due to unforeseen circumstances, such as adverse weather conditions or safety concerns. In such cases, Arborista Limited will make reasonable efforts to reschedule the Services promptly.
4. Payment Terms Payment for services provided by Arborista Limited is expected upon completion, unless an alternative arrangement has been mutually agreed upon in writing. Payment may be made in cash, by cheque, or through bank transfer; however, credit/debit cards are not accepted. Delays in payment may result in the imposition of interest charges. Arborista Limited reserves the right to recover any additional costs incurred in the process of recovering outstanding payments. In the event that the total value of the job exceeds £5000, a 50% upfront payment will be requested, with the remaining balance due on the final day of our presence on-site. Upon completion of the job, the designated team leader will request your signature on the job sheet as confirmation of your satisfaction. It is advised to sign the sheet only when assured of the completion of all items, and any concerns should be raised with the team leader or our office prior to signing the job sheet.
5. Cancellations and Refunds Amendments to or the cancellation of the Contract must be submitted in written form. In the event of cancellation, a percentage of the quoted amount will be levied to account for preparatory work already initiated and costs already incurred. Written cancellations are to be directed to treeservices@arborista.uk. Cancellations arising from actions by your neighbours, local residents, council, police, or any external party are deemed your responsibility. Refunds, if granted, will be at the discretion of Arborista Limited and may be subject to deductions. For bookings under £5,000 (including VAT): Requests for changes or cancellations must be communicated in writing (via email) a minimum of five (5) working days before the scheduled date. If a cancellation occurs while we are on-site or between five (5) to two (2) working days before the confirmed date, a charge equivalent to 50% of the quoted costs shall apply. Changes or cancellations made less than two (2) working days before the scheduled service date will be invoiced at 100% of the total job value. For bookings of or exceeding £5,000 (including VAT): Cancellations made fourteen (14) or fewer days before the scheduled date will incur a charge of 50% of the quoted costs. Changes or cancellations made less than seven (7) working days before the scheduled service date will be invoiced at 100% of the total job value.
6. Safety and Access The Client hereby agrees to furnish safe and unobstructed access to the site designated for the provision of Services. This obligation encompasses: Written permission from the relevant Local Authority in areas where Tree Preservation Orders and Conservation Orders are applicable. Owner's consent: For trees situated beyond the confines of the Client's property, written approval from the trees’ Owner is requisite before the commencement of any work. Arborista Limited shall not assume liability if such consent is not procured. The Client bears the responsibility of apprising Arborista Limited of any pre-existing conditions that might impact the delivery of Services. Such conditions encompass, but are not limited to, underground utilities, structures, or other impediments. Arborista reserves the right to decline or cease services if, in our professional judgement, the prevailing site conditions pose a risk to the safety of our personnel or equipment.
7. Property Damage The Client acknowledges that tree work inherently involves risks, and Arborista Limited bears no liability for property damage unless directly resulting from our negligence. All feasible efforts will be exerted to preserve the original condition of the work areas. However, given the intrinsic nature of our work, certain areas such as flower borders, long grass, and gravel drives may contain minor debris beyond our capacity for removal. Arborista Limited, as deemed necessary, may relocate garden furniture and ornaments. In the event of such relocation, we disclaim any liability for these items. The Client commits to notifying Arborista Limited of any pre-existing conditions that may impact the provision of services.
8. Insurance Arborista Limited maintains comprehensive insurance coverage. Nevertheless, it is strongly advised that you consult with your insurance provider to ascertain that your property is adequately covered during the provision of our services.
9. Complaints In the eventuality of any grounds for complaint arising, please promptly communicate with our office at treeservices@arborista.uk within a period of seven (7) days. We commit to addressing and rectifying the situation with due diligence.
10. Governing Law These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. By using Arborista Limited's services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. Arborista Limited reserves the right to update or modify these Terms at any time, and such changes will be effective upon posting on our website. It is your responsibility to review these Terms periodically.
